ADJUDICATION No. 391 (January 1989)

Mr M Robertson complains about a photograph which appeared in the Central Victorian News and Review of 31 August 1988. It was taken when he was participating in a football match. He complains that as a result of that publication he has been extremely embarrassed and he and his fiancee have been the subject of an enormous amount of public ridicule. The photograph "unfortunately reveals a part of his anatomy in the groin area that is not normally visible".

In reply the newspaper states that the publication was an unfortunate mistake - the photo chosen had been taken from proofs of the size of 1" x 1".

It is accepted that the newspaper used the photograph as published by error. The publication however indicates a weakness in the paper's editing procedures and the complaint is upheld.
