THE VICE PRESIDENT: The application is listed for a stay. Is there any objection to legal representation?

MR FALCONER: No objection, your Honour.

THE VICE PRESIDENT: All right. I have read the material so it s really a question of whether this matter fits within - whether a stay should be granted. As I understand the application, the matter is before Hatcher VP for programming in relation to further material on remedy.

MR GEE: Yes, your Honour.

THE VICE PRESIDENT: And you want to say that, because of the arguments you want to raise, that would be a waste of money.

MR GEE: Yes.

THE VICE PRESIDENT: Without agitating the actual merits of the appeal on the merits first. That is your point, isn't it?

MR GEE: It is, your Honour, yes.

THE VICE PRESIDENT: Is that stay opposed?

MR FALCONER: No, it s not, your Honour.

THE VICE PRESIDENT: On that basis I am comfortable to grant the stay without any argument.

THE VICE PRESIDENT: Thank you. A stay will be granted and the matter will be allocated to a Full Bench for hearing.
