PN1
THE COMMISSIONER: The company is to file and serve its arguments broadly against the case being allowed to proceed under section 739 of the Act by no later than close of business 5 January 2016. The union will not be required to file a written response and will make its responses orally at hearing on 11 January 2016. Are we all quite clear now?
PN2
MS SEGBEDZI: Thank you, Commissioner.
PN3
THE COMMISSIONER: The hearing will be held face to face in Devonport, and, Mr Nguyen, I expect you to be in Devonport. You have shown a marked reluctance so far to be in Tasmania for these things, but I'm just finding it impossible to do it by video and I do not intend to conduct the hearing by video. So you will be in Devonport?
PN4
MR NGUYEN: Yes, Commissioner, I will be in Devonport.
PN5
THE COMMISSIONER: You sound thrilled. I will be too and I will be there going on a Sunday as well. So are we all clear and moderately happy?
PN6
MS SEGBEDZI: We're content, Commissioner.
PN7
MR NGUYEN: Yes, Commissioner.
PN8
THE COMMISSIONER: All right. These proceedings are adjourned and I shall look forward to reading your stuff, Ms Segbedzi, and we will sort of look forward to the hearing on the 11th. Commission is adjourned.
PN9
MS SEGBEDZI: Merry Christmas, Commissioner.
PN10
MR NGUYEN: Merry Christmas.
PN11
THE COMMISSIONER: Happy Christmas to you. Happy and holy Christmas to you all.
ADJOURNED UNTIL MONDAY, 11 JANUARY 2016 [2.36 PM]
