DAWSON J: This application for special leave was previously considered and refused by Justices Deane, Toohey and myself. Subsequently, the Court invited the applicant to make a submission as to why an order for costs should not be made against her. After reviewing the applicant's submission, the Court considers that, in all the circumstances, the application should be refused with costs.
