MR R.S. QUINN: I appear for the respondent. (instructed by the Australian Government Solicitor)

HIS HONOUR: Mr Greer, just let me look at the information I have in relation to this matter. Mr Greer, this matter appears to have been deemed to be abandoned.

MR GREER: I did not know that, your Honour.

HIS HONOUR: I have a copy of a letter dated 18 October that was sent to you by the Registry referring to your application, referring to documents that have to be filed, and drawing your attention to the Rule of Court that provides for the abandonment of an application where an applicant fails to comply with those requirements.

MR GREER: I did not know that, your Honour. I did not know that. I did not know about abandonment, no.

HIS HONOUR: Did you receive a letter?

MR GREER: To that effect, no. I do not recall ever reading - - -

HIS HONOUR: Have a look at this document.

MR GREER: I have had a couple of letters from the High Court. That could have been one of them, your Honour. I passed them on to Mr Levy & Associates who was attempting to address the issue at hand.

HIS HONOUR: Well, there appears to be nothing for us to do. In accordance with the information contained in that letter, your application has been deemed abandoned.

MR GREER: Right.

HIS HONOUR: Is there some application you want to make about that?

MR GREER: I was under the understanding it was still under foot and that there was something else had to be done which Mr Levy was attending to. He is unavailable to attend today because he had other commitments so I have attended on his behalf.

HIS HONOUR: Just let me have a look at the judgment of the Full Court of the Federal Court.

MR GREER: I recall filing some material.

HIS HONOUR: Just take a seat, Mr Greer. I am going to have a look at the judgment of the Full Court of the Federal Court and seek to inform myself of what is involved in this appeal. Have you the judgment of Justice Burchett.

MR QUINN: I can provide your Honour with a copy, if need be.

HIS HONOUR: Thank you. Mr Greer, I am just reading the history of this matter as it is set out in the judgment of Justice Burchett in the Federal Court.

MR GREER: Yes.

HIS HONOUR: I do not propose to take any steps in this matter. I simply note that the application has been deemed to be abandoned. It can be removed from the list.

AT 10.28 AM THE MATTER WAS CONCLUDED
