MR P.R. GARLING, SC: May it please the Court. I appear with my learned friend, MR S. WOODS, for the respondent. (instructed by Lynn Boyd)
GLEESON CJ: Yes, Mr Kingsman.
MR KINGSMAN: Your Honours, I have declined to submit oral argument this morning. I believe that the material I have presented in my written documentation before the Court - - -
GLEESON CJ: All right, we have read that.
MR KINGSMAN: - - - would be sufficient, if it pleases the Court.
GLEESON CJ: All right, thank you.
We have read the written arguments that have been advanced on either side in this matter and the papers that are before us in connection with the application, and Mr Kingsman has indicated that he does not wish to add orally to his submissions.
The decision of the Court of Appeal of the Supreme Court of New South Wales related to a number of legal issues. The Court is of the view that the decision of the Court of Appeal was correct and for that reason the application for special leave to appeal should be refused with costs.
