MRS L.T. LOCKART: May it please your Honours, I appear on behalf of the appellant. (instructed by Marriott & Oliver)

MR A.R. KROUK: If the Court pleases, I appear for the respondent. (instructed by Moss Krouk & Associates)

GLEESON CJ: What about Mr Tunbridge; is he coming?

MR KROUK: He does not seem to be here but he was expected.

GLEESON CJ: As I understand it, the parties have agreed on the orders they wish us to make. We have been given some written explanation as to aspects of it. So the Court will make orders in terms of the short minutes initialled by me and placed with the papers and dated today's date.
