MR PW UZELAC appeared in person.

HAYNE J: I have a certificate from the Deputy Registrar that she has been informed by Ainsworths, the solicitors for the respondent in the matter, that the respondent will submit to any order of the Court save as to costs. Yes, Mr Uzelac.

MR UZELAC: I did state in my application book that I would take 20 minutes time for oral – I am not familiar with your terms - - -

HAYNE J: I am sorry, Mr Uzelac, you are going to have to speak up rather louder. The acoustics are not great.

MR UZELAC: Okay. I indicated I would spend 20 minutes in oral.....argument and that sort of thing, but today I have decided that I am just going to go with what is in my application book, thank you, your Honour.

HAYNE J: Yes. Well, we have, of course, read those papers. So there is nothing you wish to add, Mr Uzelac?

MR UZELAC: No, your Honour.

HAYNE J: Yes, thank you. You may sit down.

Having considered the papers that have been filed in the matter we are of the view that there is no reason to doubt the correctness of the Court of Appeal’s conclusion that leave to appeal to that court out of time should be refused. It follows that special leave to appeal to this Court should be refused.
