HIS HONOUR: Mr Costigan, I am sorry to have delayed you, but I was having some minutes of directions typed to deal with what I suspect might now be about to happen.
MR COSTIGAN: Yes. We had provided to your Honour the orders.
HIS HONOUR: Yes.
MR COSTIGAN: The only real difference from what we were saying on Friday was that the additional 14 days was not favoured, but we are comfortable with that.
HIS HONOUR: Yes.
MR COSTIGAN: Though it is a question now of the appropriate dates and - - -
HIS HONOUR: Can I give to counsel copies of a set of directions that I have put together with a view to the cases being ready for inclusion in the Adelaide list for 30 April. I know that we have Easter intervening, but I think that the dates selected enable sufficient time for the parties to address it.
MR COSTIGAN: They match very closely with what we had tried – your Honour, I was going to say significant difference – the only real difference was that instead of 12 March we had made it 15th, only to grab hold of that extra weekend, but there is no significant difference.
HIS HONOUR: I thought let us have it in on the Friday evening. We have a long weekend following. That is right, is it not? No, the long weekend is the 8th. The 15th is Canberra Day, but look, let us see if we can get it on the Friday night. It will just give that little extra time to the other side.
MR COSTIGAN: We have no reason to believe that we cannot meet those dates, your Honour.
HIS HONOUR: Yes.
MR COSTIGAN: If there was some really significant reason, we would have to come back to the Court.
HIS HONOUR: If Armageddon occurs, Armageddon occurs.
MR COSTIGAN: Yes. We are content with those orders, your Honour.
HIS HONOUR: Yes. Now, Mr Gilbertson.
MR GILBERTSON: Yes, your Honour,
my client is content with those as well.
HIS HONOUR: Yes.
Well, if I give directions in those terms, consistent with what happened on
Friday, I have not made any provision for costs
or certifying for counsel. Is
that right?
MR COSTIGAN: Yes, your Honour.
HIS HONOUR: Yes. Well, I will make directions in those terms and adjourn.
MR COSTIGAN: If your Honour pleases.
HIS HONOUR: Thank you.
