MS S.M. KLUSS: Your Honour, I appear as a matter of courtesy to the Court today pursuant to the further notice of appearance that has been placed upon the Court record. I can indicate that my instructing solicitor has had a conference with the applicant with respect to the proposed course and as such I do not feel I am in a position to provide on the submissions but to invite the Court to consider Mr Dalton and my submissions that were filed in terms of the application. (instructed by Legal Aid NSW, seeking leave to withdraw)


MR J.H. PICKERING, SC: May it please the Court, I appear for the respondent. (instructed by Solicitor for Public Prosecutions (NSW))


BELL J: Thank you. As I understand, it is the applicant’s desire to have the matter dealt with on the papers in the way the provision is made under the Rules for the Court to do so and in the ordinary course that would be done by a panel of two Justices in chambers. Mr Pickering, no difficulty with that course?


MR PICKERING: Our side have no problem with that course, your Honours.


BELL J: Thank you, Mr Pickering. Ms Kluss, thank you for your attendance today. You do have leave to withdraw. Thank you.


The application No S59/2014 will be stood out of the list. We direct that it be referred to a panel of two Justices to be determined in accordance with the provisions of rule 41.11.


The Court will now adjourn to 10.15 on Tuesday, 2 September in Brisbane.
