HIS HONOUR: Before we commence this morning with each of the listed matters, there are some determinations which have been made following applications made by various parties for leave to make submissions and to intervene in each of the matters. I will just announce the results of those applications. In the matter of the reference concerning Senator Rodney Norman Culleton, the Court makes the following orders:


  1. The following persons will be allowed to be heard on the hearing of the reference and shall be deemed to be parties to the reference pursuant to section 378 of the Commonwealth Electoral Act 1918: (1) Senator Rodney Norman Culleton; (2) the Attorney-General of the Commonwealth.
  2. Gregory Castle Jones will not be allowed to be heard on the hearing of reference.
  3. Roger Laws will not be allowed to be heard on the hearing of the reference.
  4. The submissions of John David McClymont and Dennis John Fahey will not be received and will not be taken into account on the hearing of the reference.

I publish that determination and the reasons.


In relation to the reference concerning Mr Day the orders of the Court are:


  1. The following persons shall be allowed to be heard on the hearing of the reference and shall be deemed to be parties to the reference pursuant to section 378 of the Commonwealth Electoral Act 1918: (1) Robert John Day; (2) the Attorney-General of the Commonwealth; (3) Anne McEwen.
  2. Roger Laws will not be allowed to be heard on the hearing of the reference.
