HIS HONOUR: Gentlemen, before taking appearances I shall deal with the determinations made in relation to the applications to place evidence before or make submissions to the Court.


The Court received references in these matters from the Senate between 15 and 28 November 2017. The Court published notices on 17 and 29 November 2017, inviting persons to apply to the Court to be heard or to make submissions on the hearing of the references. The closing dates for the applications were 30 November and 6 December 2017. I have made determinations with respect to each application received.


In the reference concerning Mr Stephen Parry, received by the Court on 15 November 2017, I order that:


  1. The following persons shall be allowed to be heard on the hearing of the reference and shall be deemed to be parties to the reference pursuant to s 378 of the Commonwealth Electoral Act 1918 (Cth):

(i) The Attorney-General of the Commonwealth; and


(ii) Katrina Melissa McCulloch.


  1. The submissions of Terence Michael Dwyer, Ross Drynan and “Jeremiah 23:29” will not be received by the Court and will not be taken into account on the hearing of the reference.

I publish that determination and my reasons for it.


In the reference concerning Ms Jacqui Lambie, received by the Court on 15 November 2017, I order that:


  1. The following persons shall be allowed to be heard on the hearing of the reference and shall be deemed to be parties to the reference pursuant to s 378 of the Commonwealth Electoral Act 1918 (Cth):

(i) The Attorney-General of the Commonwealth;


(ii) Steven Leigh Martin; and


(iii) Katrina Melissa McCulloch.


  1. The submissions of Terence Michael Dwyer and “Jeremiah 23:29” will not be received by the Court and will not be taken into account on the hearing of the reference.

I publish that determination and my reasons for it.


In the reference concerning Ms Kakoschke-Moore, received by the Court on 28 November 2017, I order that:


  1. The following persons shall be allowed to be heard on the hearing of the reference and shall be deemed to be parties to the reference pursuant to s 378 of the Commonwealth Electoral Act 1918 (Cth):

(i) Skye Kakoschke-Moore;


(ii) The Attorney-General of the Commonwealth; and


(iii) Timothy Raphael Storer.


  1. The submissions of Terence Michael Dwyer and “Jeremiah 23:29” will not be received by the Court and will not be taken into account on the hearing of the reference.

I publish that determination and my reasons for it.
