KIEFEL CJ: The parties to this appeal filed a consent on 27 January 2021 to the making of orders disposing of the proceeding. The Court makes the following orders:

1. Appeal allowed in part.

  1. Set aside orders 2 to 11 of the orders made by the Supreme Court of Queensland on 10 September 2018 and orders 2 and 3 of the orders made by the Court of Appeal of the Supreme Court of Queensland on 7 May 2019, and in their place order that:

(a) proceeding number BS2252 of 2017 in the Supreme Court of Queensland be discontinued, and

(b) each party bear its own costs of the proceedings in the Supreme Court of Queensland and in the Court of Appeal of the Supreme Court of Queensland.

3. Appeal otherwise dismissed.

4. Each party bear its own costs of the appeal to this Court.
