1Name of Instrument

This Instrument is the Greenhouse and Energy Minimum Standards (Exemption) Instrument (No.1) 2017.

2Authority

This Instrument is made under subsections 37(1) and (2) of the Greenhouse and Energy Minimum Standards Act 2012.

3Commencement

This Instrument commences the day after it is registered.

4Definitions

In this Instrument:

Act means the Greenhouse and Energy Minimum Standards Act 2012.

Determination means the Greenhouse and Energy Minimum Standards (Three Phase Cage Induction Motors) Determination 2012.

Exempt Model: see section 5 of the Instrument.

Note: Several other words and expressions used in this instrument have the meaning given by section 5 of the Act. For example:

• GEMS

• GEMS determination

• GEMS labelling requirements

• GEMS level requirements

• model

• model identifier

• product classes

• supply

5Exemption

The model specified in clause 1 of the Schedule (the Exempt Model) is exempt from the requirements of the Determination as described at clause 2 of the Schedule with respect to the supplies of the exempt model specified at clause 3 of the Schedule.

6Conditions of exemption

The conditions at clause 4 of the Schedule are specified for the purposes of subsection 37(2) of the Act.

Note: Subsection 37(2) of the Act provides that the exemption may specify conditions to which the exemption is subject. Subsection 37(3) provides that a person must comply with a condition of an exemption to the extent that it applies to the person.

2Requirements from which model is exempt

Requirements of the Determination as follows:

GEMS level requirements (section 6)

The models are exempted from the energy use requirements mentioned in section 6 of the Determination.

3Supplies to which the exemption applies

This exemption only applies in relation to the supply of three phase cage induction motors with the specifications set out in clause 1 above.

4Specification of conditions of exemption

The exemption is subject to the condition that the supply of the products specified in clause 1 above is restricted to the Ichthys LNG Onshore Project located at Bladin Point in Darwin.
