Judgment:

18 December 2002

JUDGMENT OF THE COURT DELIVERED BY ANDERSON J

[1]This is an application for special leave to appeal against a decision of the High Court at Palmerston North apparently in respect of the conviction of Mr Greer on an information laid pursuant to s58C(5)(b) of the Transport Act 1962.
[2]The Notice of Application refers to the date of determination of the High Court as 7 March 2002 but inquiries indicate no relevant documentation on that date.It is likely that the relevant date is 3 July 1996.In any event, there is no record of an application to the High Court itself for leave to appeal to this Court and the taking of such a step with a consequential refusal by the High Court is a precedent condition to this Court’s jurisdiction to entertain the present application.
[3]That application for special leave is therefore dismissed for want of jurisdiction at the present time.
