NOTES OF JUDGE C J THOMPSON ON SENTENCING
[1] For the reasons that I outlined yesterday at the sentence indication hearing, and that has been transcribed and has in fact arrived now for confirmation, the defendant, Pfdl (5) Limited, is convicted on that charge.
[2] The company will be fined $20,000. There will be an order under s 342 Resource Management Act 1991 that 90 percent of that fine is to be paid to the Manawatu-Wanganui Regional Council.
[3] There is to be an enforcement order in terms to be agreed with the Court requiring, among other actions, work to be done by the defendant company to the value of $20,000.
[4] The terms of that enforcement order are, as I say, to be confirmed with the Court, and I would ask that a draft be lodged with the Court as soon as convenient

and the Court then may have some perhaps wording issues that will require discussion with counsel, but I think that they will be relatively minor-looking towards perhaps the ease of enforcement and so on, as I see it from the draft.
