ORAL JUDGMENT OF JUDGE J E MAZE
[1] This is an appeal by Neal Springs against a decision of the Tenancy Tribunal.
[2] A stay of enforcement has been granted pending the hearing of the appeal.
[3] It is now 13 minutes past 10. There have been repeated calls and checks for the appellant. He has not appeared and there is no appearance on his behalf. Counsel for the respondent confirms that there has been no sighting of Mr Springs today. On that basis, I have no option but to dismiss the appeal. I am satisfied that Mr Springs was notified of the time and date of hearing and was in receipt of the order staying enforcement.
[4] Accordingly, the appeal is dismissed. The order of the Tribunal will now be enforceable.
