High Court of New Zealand Decisions |
Last Updated: 7 July 2011
IN THE HIGH COURT OF NEW ZEALAND REGISTRY
CRI 2010-404-256
IN THE MATTER OF an appeal from the Determination of the
District Court at Auckland
AND IN THE MATTER OF Section 107(3) of the Summary
Proceedings Act 1957
BETWEEN TV WORKS LIMITED Applicant
AND DEPARTMENT OF INTERNAL AFFAIRS Respondent
Hearing: On Papers
Counsel: J R Billington QC and J Edwards for Applicant
R McCoubrey and S Cohen-Ronen for Respondent
Judgment: 7 March 2011
JUDGMENT OF RONALD YOUNG J (Application for leave to appeal)
[1] In these proceedings I allowed an appeal against a decision of the District Court and concluded that advertising for the Asia Pacific Poker Tour on two television channels, TV3 and C4 was publicising or promoting gambling. TV Works now wishes to appeal to the Court of Appeal.
[2] I am satisfied that leave should be given. There is an identifiable question of law. I accept that the issues raised are important to broadcasters and advertisers and
do have an element of public interest.
TV WORKS LIMITED V DEPARTMENT OF INTERNAL AFFAIRS HC CRI 2010-404-256 7 March 2011
[3] Leave to appeal is therefore granted.
