Last Updated: 10 February 2013
IN THE HIGH COURT OF NEW ZEALAND TIMARU REGISTRY
CIV-2009-476-000571 [2012] NZHC 3506
UNDER the Insolvency Act 2006
IN THE MATTER OF the bankruptcy of ROGER JOHN PAYNE BETWEEN ROGER JOHN PAYNE
Judgment Debtor
AND NEW ZEALAND NATIONAL PARTY Judgment Creditor
Hearing: 18 December 2012 (On the Papers)
Judgment: 18 December 2012
JUDGMENT OF FOGARTY J
[1] On 17 December 2012, Associate Judge Matthews adjudicated on Mr Payne’s application of 21 September 2012, which I had interpreted as effectively an application seeking recall of this Court’s decision adjudicating him bankrupt.
[2] Associate Judge Matthews has considered the application of 21 September and rejected it, leaving the adjudication and bankruptcy in place. As a result, there is no longer any continuing reason for my order preventing sealing of the adjudication. That was an interim order only, to enable the application of 21 September to be
heard.
PAYNE V NEW ZEALAND NATIONAL PARTY HC TIM CIV-2009-476-000571 [18 December 2012]
[3] To the extent it is necessary to say so, this decision is to the effect that there is nothing preventing the sealing of the order of adjudication made on 19 September
2012.
