JUDGMENT OF DUNNINGHAM J
[1] Having read the application and the supporting
affidavit of Christina Anna Stachurski, I am satisfied
that this is an
application where it is appropriate to declare the testamentary document of
Howard Douglas McNaughton, to
be a valid will pursuant to s 14 of the Wills Act
2007.
[2] The application has been served on the deceased’s four
children as directed by the Court. I have affidavits of service
for all four of
them. No party has sought to be heard, or registered any opposition to the
application.
[3] Accordingly, I grant the application on the terms that were
sought.
