DECISION
This is an application by a Police Officer, Sergeant Derek Beveridge, for suspension of General Manager’s Certificate number GM 2681/93 issued to Fleur de Lyse Ross Sullivan. The application is made under s.135(3)(b) of the Act.
The ground for the application, dated 19 August 2002, is that the conduct of Ms Sullivan is such as to show that she is not a suitable person to hold the certificate. On 4 July 2002 Ms Sullivan was convicted in the Oamaru District Court of driving with an excess blood alcohol level. The level of alcohol in her blood was 142 milligrams of alcohol per 100 millilitres of blood.
In an application by the respondent for an on-licence, LLA PH 533/2002, we said:
“The Police have made an application to suspend Ms Sullivan’s manager’s certificate. It may well be that they and Ms Sullivan can reach agreement on an appropriate period of suspension.”
The Police and Ms Sullivan have agreed to the suspension of her certificate for a period of three months from 1 February 2003. General Manager’s Certificate number GM 268/93 is hereby suspended accordingly.
