Decision No. 109/2003
IN THE MATTER of the Sale of Liquor Act 1989
AND
IN THE MATTER of an application by STARTIME LIMITED pursuant to s.18 of the Act for renewal of an on-licence in respect of premises situated at 152 Manchester Street, Christchurch, known as “Treehouse"
BEFORE THE LIQUOR LICENSING AUTHORITY
Chairman: District Court Judge E W Unwin
Member: Mr J C Crookston
DECISION
This is an application by Startime Limited for renewal of an on-licence in respect of premises situated at 152 Manchester Street, Christchurch, known as “Treehouse”.
Public notification of the application attracted an objection, which purports to challenge the suitability of the applicant. Reports from the Police and the District Licensing Agency do not support the objection, and we are not persuaded that the applicant is not suitable.
Having considered the application we take the view that the matters raised by the objector fall outside the scope of the Act in terms of 2.106(2)(b). We will deal with the matter on the papers.
We are satisfied as to the matters to which we must have regard as set out in s.22 of the Act. We renew the licence until 31 August 2005, that being three years from the first anniversary of the licence and authorise the issue of a notice of renewal.
DATED at WELLINGTON this 6th day of March 2003
