DECISION
This is an application by Le Chic Limited for renewal of an on-licence in respect of premises situated at First Floor, 51 High Street, Auckland, known as "Lounge".
Public notification of the application did not attract any objection, but renewal of the on-licence was opposed by the Police and the District Licensing Agency Inspector.
The basis for this opposition relates to the conditions of the licence, which authorise the sale of liquor on such days and during such hours as the premises are being operated as a venue for entertainment or social functions.
The Police and Agency Inspector contend that the business operates as a tavern, i.e. premises in which the principle business is the sale and consumption of liquor. They recommend that the licence conditions be varied to reflect more accurately the nature of the business.
The applicant has accepted this recommendation and opposition is now withdrawn. We will deal with the matter on the papers.
We are satisfied as to the matters to which we must have regard as set out in s.22 of the Act. We renew the licence until 21 June 2005, that being three years from the first anniversary of the licence and authorise the issue of a replacement licence and a notice of renewal.
