DECISION

This is an application by Ronald Francis Burgess, Tauranga District Licensing Agency Inspector, for cancellation of General Manager’s Certificate number GM 4835/99 issued to Dereda Jane Lipsey-MacLean. This application is made under s.135(3)(b) of the Act.

The basis for the application is that the conduct of Ms Lipsey-Maclean is such as to show that she is not a suitable person to hold a certificate. Following the conclusion of investigations conducted by the Police at Mount Maunganui, Ms Lipsey-MacLean was arrested and charged with seven serious offences under the Misuse of Drugs Act 1975. We have been informed that Ms Lipsey-MacLean has subsequently pleaded guilty to these charges.

Ms Lipsey-MacLean has stated that she accepts the District Licensing Agency Inspector’s evidence and confirms that she does not seek to defend the application for cancellation of her certificate. General Manager’s Certificate number GM 4835/99 issued to Dereda Jane Lipsey-MacLean (formerly Dereda Jane Lipsey) is hereby cancelled.

DATED at WELLINGTON this 14th day of March 2003
