New Zealand Liquor Licensing Authority |
Last Updated: 21 July 2010
Decision No. 275/2003
IN THE MATTER of the Sale of Liquor Act 1989
AND
IN THE MATTER of an application by MERVYN ROBERT WALSDORF pursuant to s.123 of the Act for a General Manager’s Certificate
BEFORE THE LIQUOR LICENSING AUTHORITY
Chairman: District Court Judge E W
Unwin
Member: Mr J C Crookston
DECISION
The applicant is the holder of General Manager’s Certificate number GM 2770/97 and has applied to the New Plymouth District Licensing Agency pursuant to s.123 of the Act, for renewal of that certificate.
The application initially attracted adverse reports from the Police and District Licensing Agency Inspector, which refer to the applicant’s conviction on 4 April 2000 for driving with an excess blood alcohol level. The applicant also has a conviction on 24 July 1978 for driving with an excess breath alcohol level. The Police and Agency Inspector have subsequently withdrawn their opposition due to the period of time that has elapsed since the most recent offence.
We will now deal with the matter on the papers.
We are now satisfied as to the matters to which we must have regard as set out in s.126 of the Act and we grant the application.
DATED at WELLINGTON this 17th day of April 2003
