DECISION

The applicant is the holder of General Manager’s Certificate number GM 3601/98 and has applied to the New Plymouth District Licensing Agency pursuant to s.123 of the Act for renewal of that certificate.

In their reports on the application, the Police and District Licensing Agency Inspector opposed the application on the basis of the applicant’s conviction on 7 July 2001 for driving with an excess breath alcohol level.

By consent, the applicant and reporting authorities have agreed to a renewal period of two years only. Accordingly, we deal with the matter on the papers.

We are now satisfied as to the matters to which we must have regard as set out in s.126 of the Act. We grant the application and renew the certificate to 29 September 2004, that being an anniversary of its original grant.
