BETWEEN TRACY PATTERSON

Applicant

AND SALLY ANNE ALLEN

Respondent

BEFORE THE LIQUOR LICENSING AUTHORITY

Chairman: District Court Judge E W Unwin
Member: Mr J C Crookston

HEARING at WANGANUI on 23 October 2003

APPEARANCES

Senior Sergeant C R Irvine - NZ Police - applicant
Mr R J S Munro - for respondent
Mr J D Bonner - Wanganui District Licensing Agency Inspector - to assist

ORAL DECISION OF THE AUTHORITY

[1] Before the Authority is an application by the Police for the cancellation of a General Manager’s Certificate issued to Sally Anne Allen. The grounds for the application are that the manager had failed to conduct licensed premises in a proper manner. There is a second ground that the conduct of the manager is such as to show that she is not a suitable person to hold a certificate.

[2] Mr R J S Munro has been acting for Ms Allen. On her instructions he has advised that the application is not to be opposed. If it was legally possible to do so, Ms Allen would have been prepared to surrender her certificate. In those
[3] circumstances no further evidence is necessary, and the Authority cancels General Manager’s Certificate number 036/GM/33/2002 issued to Sally Anne Allen.

DATED at WELLINGTON this 30th day of October 2003
