ORAL DECISION OF THE AUTHORITY
[1] This is an application by Khammapat Boom Dickie pursuant to s.118 of the Act for a General Manager’s Certificate. The criteria to which we must have regard are set out in s.121 of the Act. Those criteria are:
- [a] The character and reputation of the applicant:
[b] Any convictions recorded against the applicant:
[c] Any experience, in particular recent experience, that the applicant has had in managing any premises or conveyance in respect of which a licence was in force:
[d] Any relevant training, in particular recent training, that the applicant has undertaken and any relevant qualifications the applicant holds:
[e] Any matters dealt with in any report made under section 119.
[2] The matters at issue are the applicant’s knowledge of the Act and experience managing any premises.
[3] The Inspector has opposed the application because when Ms Dickie was interviewed, she was unable to answer fundamental questions about the Sale of Liquor Act. Although the interview was rescheduled to another time to allow Ms Dickie time to revise the Act, she did not present herself for another interview, despite messages being left on her phone.
[4] To date, she has not contacted the Agency. Consequently, the Inspector has not been able to assess her knowledge of the Act or her suitability to be the holder of a General Manager’s Certificate.
[5] Ms Dickie has not appeared today to support her application. In all the circumstances, it would appear that she has no further interest in pursuing her application.
[6] Accordingly, Ms Dickie’s application for a General Manager’s Certificate is refused.
DATED at WELLINGTON this 14th day of December 2004
