Mr R S Putze – Wellington District Licensing Agency Inspector – in opposition

ORAL DECISION OF THE AUTHORITY

[1] This is an application by Matthew Tane Mason for the renewal of his General Manager’s Certificate.

[2] Mr Mason was first granted a General Manager’s Certificate on 15 February 2000. The certificate has been renewed and fell due again for renewal on 15 February last. During the interim period of time the Sale of Liquor Act was amended to provide that as from 1 April 2006, neither the Agency nor the Authority, was able to issue or renew a General Manager’s Certificate without the applicant having attained the Licence Controller Qualification.

[3] Mr Mason has not attained this qualification. He was spoken to in May 2006 and said that he had he booked into a course. However, he failed to get back to the Agency, and he has also failed to appear in support of his application.

[4] There was a further matter. The Inspector wished to obtain more information about the applicant’s response to the question of the steps that the applicant had taken to manage the sale and supply of liquor pursuant to the licence with the aim of contributing to the reduction of liquor abuse.

[5] There has been no response from Mr Mason to this request either.
[6] In the light of his non-appearance and the non production of the Licence Controller Qualification, the application for renewal of the certificate must be declined.

DATED at WELLINGTON this 16th day of October 2006
