Decision No. PH 965/2006
IN THE MATTER of the Sale of Liquor Act 1989
AND
IN THE MATTER of an application by HILARY JANE ORD pursuant to s.123 of the Act for renewal of a General Manager’s Certificate
BEFORE THE LIQUOR LICENSING AUTHORITY
Chairman: District Court Judge E W
Unwin
Member: Ms P A Ballard
HEARING at HENDERSON on 30 October 2006
APPEARANCES
Ms H J Ord – applicant
Mr G S Whittle – Auckland District
Licensing Agency Inspector – in opposition
ORAL DECISION OF THE AUTHORITY
[1] Before the Authority is an application by Hilary Jane Ord for the renewal of her General Manager’s Certificate.
[2] Ms Ord has held a certificate since 1999. The application was referred to the Authority because there was no Licence Controller Qualification, notwithstanding requests for a copy of this document to be produced.
[3] The position is that since 1 April last neither the Agency nor the Authority can renew a General Manager’s Certificate without the applicant having obtained the qualification.
[4] At the hearing we received information confirming that Ms Ord had been unwell and was unable to attend the required examination. She has appeared before us to confirm that she should obtain the qualification within the next two months.
[5] The application is adjourned on the basis that if a copy of the certificate is produced to the District Licensing Agency Inspector within the next two months then the application will be granted. If no such copy certificate is produced within that time span then the application will be declined.
[6] The application is adjourned accordingly.
DATED at WELLINGTON this 2nd day of November 2006
