Decision No. PH 988/2006

IN THE MATTER of the Sale of Liquor Act 1989

AND

IN THE MATTER of an application by SHELLEY ANNE ANDREE pursuant to s.123 of the Act for renewal of a General Manager’s Certificate

BEFORE THE LIQUOR LICENSING AUTHORITY

Chairman: District Court Judge E W Unwin
Member: Ms P A Ballard

HEARING at AUCKLAND on 2 November 2006

APPEARANCES

Ms S A Andree – applicant
No appearance by or on behalf of an Auckland District Licensing Agency Inspector

ORAL DECISION OF THE AUTHORITY

[1] Before the Authority is an application by Shelley Anne Andree for the renewal of her General Manager’s Certificate.

[2] Ms Andree was granted her certificate on 13 April 1996 and the certificate fell due for renewal on 3 April 2006. On 1 April of this year the Act was amended to provide for the fact that no General Manager’s Certificate can be renewed either by the Agency or by the Authority without the acquisition of the Licence Controller Qualification.

[3] In her application, Ms Andree noted that she was the mother of three year old twins and that she intended to return to work in December 2006 at which time she believed that she would be able to complete the Licence Controller Qualification examination. There has since been correspondence with the Agency but a copy of the qualification has not been forwarded.

[4] Ms Andree has appeared in support of her application. She has explained that she is currently having medical treatment but expects to be able to complete the examination between now and February of next year. We have accepted her explanation as well as the reasons why the qualification has not been obtained until now.

[5] Accordingly we propose to adjourn the application for three months. If a copy of the qualification is filed with the Agency within that time then we will renew the certificate on the papers for a period of three years. If no qualification is produced and there is no further communication from the applicant, the application will be refused.

DATED at WELLINGTON this 8th day of November 2006
