ORAL DECISION OF THE AUTHORITY

[1] This is an application by Kerrin Leeanne Michelle Tandy for a General Manager’s Certificate.

[2] The application was filed with the Auckland District Licensing Agency on 28 March 2006. At the time of the filing of the application Ms Tandy was working at licensed premises in Waiheke Island known as “The Lazy Lounge”. However inquiries revealed that she has since moved to Australia and there has been no further contact with her.

[3] In the interim period of time the Act has been amended to provide for the need for all applicants to be the holders of the Licence Controller Qualification. No such qualification is on file. Ms Tandy has failed to appear in support of her application. Previous cases confirm that General Manager’s Certificates will not be issued unless there is work currently available within the industry, and the certificate is to be used as a working document and not just as a bankable resource.

[4] In all those circumstances we have no hesitation in refusing the application.

DATED at WELLINGTON this 19th day of March 2007

B M Holmes
Deputy Secretary
