BEFORE THE LIQUOR LICENSING AUTHORITY

Chairman: District Court Judge E W Unwin
Member: Ms J D Moorhead

HEARING at PUKEKOHE on 21 October 2008

APPEARANCES

No appearance by or on behalf of applicant
Sergeant G Campbell – NZ Police – in opposition

ORAL DECISION OF THE AUTHORITY

[1] This is an application for a General Manager's Certificate by Renee Christine Bidois. The application was lodged with the Franklin District Licensing Agency on 21 August 2006. At that time the applicant was working at the "Monarch Café" in Pukekohe.

[2] The Agency wrote to the applicant by letter dated 22 August 2006 asking her to attend an interview. There was no response from the applicant. Subsequent telephone calls and messages were left and a further letter sent on 28 May 2007 without any response.

[3] The Police have reported on the application and have not raised any matters in opposition. The applicant has attended a training course and has obtained the Licence Controller Qualification.

[4] Despite the best efforts of the Agency staff they have not been able to contact the applicant and arrange an interview. The matter was accordingly set down for a public hearing. There was no appearance by the applicant and no explanation for the non appearance.

[5] We draw the inference that the applicant is no longer interested in pursuing the application and in any event the applicant is unable to establish the criteria set out in s.121 of the Act to our satisfaction.

[6] Accordingly the application is refused.

DATED at WELLINGTON this 30th day of October 2008
