Decision No. 648/2008
IN THE MATTER of the Sale of Liquor Act 1989
AND
IN THE MATTER of an application by CYNTHIA HARRISON pursuant to s.118 of the Act for a General Manager’s Certificate
BEFORE THE LIQUOR LICENSING AUTHORITY
Chairman: District Court Judge E W Unwin
Member: Mr P M McHaffie
FINAL DECISION
In decision number LLA PH 1032/2007, following a public hearing at Whangarei on 2
October 2007, we adjourned an application by Cynthia Harrison for a General
Manager’s Certificate for six months.
The District Licensing Agency Inspector had opposed the application on the basis of criminal convictions incurred between 1976 and 2001. These were acknowledged as being mostly of some antiquity, but the situation was compounded to some degree by the applicant’s lack of managerial experience.
In the circumstances we elected to adjourn the application to permit Ms Harrison to continue to work in licensed premises where she could be appointed as a temporary manager from time to time.
The Police and the Agency Inspector have advised our Secretary that there have been no further matters of concern brought to their attention during the period of adjournment. A supportive reference has been provided by the applicant’s employer and it is recommended that the application now be approved.
We are satisfied as to the matters to which we must have regard in s.121(1) of the
Act and we grant the application. The certificate may issue immediately.
DATED at WELLINGTON this 20th day of May 2008
B M Holmes
Deputy Secretary
