IN THE MATTER of the Sale of Liquor Act 1989
AND
IN THE MATTER of an application by PAUL ERIC ROHDE pursuant to s.123 of the Act for renewal of a General Manager's Certificate
BEFORE THE LIQUOR LICENSING AUTHORITY
Chairman: District Court Judge E W Unwin
Member: Dr J Horn
HEARING at NAPIER on 24 January 2008
APPEARANCES
Mr P E Rohde – applicant
Mr J H Lovatt – Hastings District
Licensing Agency Inspector – in opposition
ORAL DECISION OF THE AUTHORITY
[1] This is an application by Paul Eric Rohde for renewal of his General Manager's Certificate. Mr Rohde has held his certificate since 1994. The correct number for the certificate is GM 1060/94. The certificate has been renewed on a regular basis however on 1 April 2006 the Act was amended to provide that the certificate could no longer be renewed unless the applicant was the holder of the Licence Controller Qualification.
[2] Mr Rohde was spoken to in May of last year when he said he would take steps to obtain the qualification. Because there was a delay of some four months the matter was set down for hearing by the Authority in anticipation that it would be refused. In January Mr Rohde advised that he had sat and passed the transition test. He has now confirmed that with us and in particular we note that he has a good knowledge of his duties and responsibilities under the Sale of Liquor Act and he has for some time, been a manager of a large bottle store in Hastings.
[3] The application for renewal is adjourned for one month. If during the course of that month Mr Rohde produces a copy of the Licence Controller Qualification the
[3] application will be granted accordingly. If there are other difficulties there will either be a further public hearing or the application will be declined.
DATED at WELLINGTON this 4th day of February 2008
