ORAL DECISION OF THE AUTHORITY

[1] This is an application by Jianwu Lin for a General Manager's Certificate. The application was filed with the Auckland District Licensing Agency on 26 March 2007.

[2] At that time Mr Lin said that he was working at licensed premises known as "KTV Bar". The applicant was written to and asked to attend for an interview with the Inspector on at least two occasions, and failed to do so. Furthermore, the Agency received evidence that the applicant had been served with the removal order by the Department of Immigration.

[3] The Police noted that the proposed licensed premises were no longer operating. We understand that more recently, new owners have taken over the premises.

[4] Mr Lin has failed to appear. Although he is the holder of the Licence Controller Qualification, it is clear to us from all the circumstances that he has no further interest in pursuing his application, which is now refused.

DATED at WELLINGTON this 13th day of February 2008
