Decision No. 71/2009
IN THE MATTER of the Sale of Liquor Act 1989
AND
IN THE MATTER of an application by CINDY ATATU YORKE pursuant to s.118 of the Act for a General Manager’s Certificate
BEFORE THE LIQUOR LICENSING AUTHORITY
Chairman: District Court Judge E W Unwin
Members: Dr J Horn
Mr P M McHaffie
Ms J D Moorhead
FINAL DECISION
In decision LLA PH 1018/2008, following a public hearing at Whangarei on 9 July 2008, we adjourned an application by Cindy Atatu Yorke for a General Manager’s Certificate for six months.
The Police and District Licensing Agency Inspector had opposed the application on the basis of a conviction incurred by Ms Yorke in respect of a liquor related driving offence. In other respects the applicant was deemed to be suitable, but we adopted our general approach of requiring a minimum offence-free period to elapse prior to the approval of such an application.
The Police and Agency Inspector have advised our Secretary that there have been no further matters of concern brought to their attention during the period of adjournment, and opposition to the application is now withdrawn.
We are satisfied as to the matters to which we must have regard in s.121(1) of the Act and we grant the application. The certificate may issue immediately.
DATED at WELLINGTON this 23RD day of January 2009
