ORAL DECISION OF THE AUTHORITY
[1] Before the Authority is an application by Uaina Liki pursuant to s.118 of the Act for a General Manager’s Certificate.
[2] In considering any application for a General Manager’s Certificate the Authority must have regard to the following matters as set out in s.121 of the Act:
(a) The character and reputation of the applicant:
(b) Any convictions recorded against the applicant:
(c) Any experience, in particular recent experience, that the applicant has had in managing any premises or conveyance in respect of which a licence was in force:
(d) Any relevant training, in particular recent training, that the applicant has undertaken and evidence the applicant holds the prescribed qualification required under section 117A:
(e) Any matters dealt with in any report made under section 119.
[3] The applicant filed the application with the Waitakere District Licensing Agency on 15 September 2006.
[4] In the main the applicant fulfils the criteria for the grant of a certificate. The applicant is the holder of the Licence Controller Qualification which was issued on 24 August 2006. There was no Police opposition to the grant of the certificate.
[5] The Waitakere District Licensing Agency opposed the application based on four separate interviews which were held with the applicant to ascertain her knowledge of the Sale of Liquor Act. She failed all four interviews and has been unable to demonstrate a satisfactory knowledge and understanding of the Sale of Liquor Act 1989 and host responsibility.
[5] There was no appearance by the applicant before the Authority and the assumption is that the applicant is no longer interested in pursuing her application. As a consequence the application is now refused.
