IN THE MATTER of an application pursuant to s.132 of the Act for suspension of off-licence number 007/OFF/443/2009 issued to CARTEL CREST MANAGEMENT LIMITED in respect of premises situated at 38 Fort Street, Auckland, known as "Fat Camel Hostel & Bar"

BETWEEN BRIDGET JANE SUCKLING

(Police Officer of Auckland)

Applicant

AND CARTEL CREST MANAGEMENT LIMITED

Respondent

BEFORE THE LIQUOR LICENSING AUTHORITY

Chairman: District Court Judge J D Hole
Member: Mr P M McHaffie

DECISION

We have before us an application by Constable B J Suckling dated 16 July 2010, for suspension of an on-licence. The ground for the application is that that the premises have been conducted in breach of the provisions of s.168 of the Act – allowing drunkenness or disorderly conduct on licensed premises.

During a routine compliance visit to licensed premises known as “Fat Camel Hostel & Bar” on 22 July 2010, Constable Suckling observed a male patron in the premises whom she assessed as being extremely intoxicated. This assessment was confirmed by another Police officer in the premises. The patron was subsequently arrested on an unrelated matter.

The respondent does not dispute the ground for the application and has agreed to suspension of the on-licence. Accordingly, we make the following order by consent:

On-licence number 007/ON/443/3009, issued to Cartel Crest Management Limited, is suspended for 24 hours from 7.00 am on Sunday 3 October 2010.

DATED at WELLINGTON this 29TH day of September 2010
