DECISION

This is an application by Kerala Traders Limited for renewal of an on-licence in respect of premises situated at 570 Hillsborough Road, Mt Roskill, Auckland, known as "Zyka Indian Cuisine".

The business trades as a restaurant will hours authorised for the sale of liquor between 7.00 am and 3.00 am daily. No changes are sought to the conditions of the licence.

The application was duly advertised and no objection or notice of desire to be heard has been received.

The Police and District Licensing Agency Inspector do not oppose renewal. However, a Police report dated reveals that on 25 June 2009, Paramu Anil Kumar, the sole director and shareholder of the applicant was processed for driving with excess blood/breath alcohol. He subsequently pleaded guilty on 5 February 2010, was fined and disqualified from driving for six months.

The applicant does not dispute the facts as outlined in the Police report and it has agreed to accept a shortened period of renewal of the licence. Accordingly we deal with the matter on the papers.

We are satisfied as to the matters to which we must have regard as set out in s.22 of the Act. We renew the licence on the existing terms and conditions until 20 January 2012, that being 18 months from the first anniversary of the licence, and we authorise the issue of a notice of renewal.
