BETWEEN JOHN LEWIS
(Police Officer of Wellington)
Applicant
AND WILLEM PIETER VAN EPENHUIJSEN
Respondent
BEFORE THE LIQUOR LICENSING AUTHORITY
Quorum: Mr P M McHaffie
Ms J D Moorhead
DECISION
We have before us an application by Sergeant J Lewis of Wellington Police, dated 23 November 2010, for suspension of a General Manager’s Certificate held by Willem Pieter Van Epenhuijsen.
The ground for the application is that the conduct of the manager has been such as to show that he is not a suitable person to hold the certificate. In particular on 18 September 2010 Mr Van Epenhuijsen was arrested for disorderly behaviour following an incident at the entrance of licensed premises. Mr Van Epenhuijsen had been drinking and was intoxicated at the time. Subsequently Mr Van Epenhuijsen was granted diversion and the charges were withdrawn.
The respondent does not dispute the grounds of application and has agreed to the suspension of his certificate. Accordingly, we make the following order by consent:
General Manager’s Certificate number 049/GM/79/2010, issued to Willem Pieter Van Epenhuijsen, is suspended for four weeks from Monday 31 January 2011.
DATED at WELLINGTON this 8th day of December 2010
