IN THE MATTER of the Sale of Liquor Act 1989
AND
IN THE MATTER of an application by RHYS WILLIAM GITTINGS pursuant to s.118 of the Act for a General Manager’s Certificate
BEFORE THE LIQUOR LICENSING AUTHORITY
Quorum: Mr P M McHaffie
FINAL DECISION
In decision [2010] NZLLA PH 755, following a public hearing at Hamilton on 7 July 2010, we adjourned an application by Rhys William Gittings for a General Manager’s Certificate for four months.
The Police had opposed the application on the basis of a conviction incurred in November 2008 following a charge of obstructing the Police. Mr Gittings failed to declare the conviction on his application for the certificate.
Given the lapse of time since the offence we elected to adjourn the matter for a short time and then seek a further report from the police and confirmation from the applicant’s employer that he was to be engaged in a managerial capacity.
The Police have advised our Secretary that there have been no further matters of concern brought to their attention during the period of adjournment, and opposition to the application is now withdrawn. Our Secretary has also received confirmation of Mr Gittings’ continued employment.
We are satisfied as to the matters to which we must have regard in s.121(1) of the Act and we grant the application. The certificate may issue immediately.
DATED at WELLINGTON this 23rd day of December 2010
