FINAL DECISION
In decision NZLLA PH 1198/2009, following a public hearing at Christchurch on 25 September 2009, we adjourned an application by Joel Arlow Christian for a General Manager’s Certificate for four months.
The Police had opposed the application on the basis of two convictions incurred by Mr Christian following liquor related driving offences. One of these had occurred in 2005 when the applicant was still a teenager and the registered blood alcohol level would not have constituted an offence had he been over the age of 20. The second offence took place on New Year’s Day 2008.
In the circumstances we elected to adopt our generally accepted approach of requiring a minimum offence-free period of two years from the most recent offence.
The Police and Agency Inspector have advised our Secretary that there have been no further matters of concern brought to their attention during the period of adjournment, and opposition to the application is now withdrawn.
We are satisfied as to the matters to which we must have regard in s.121(1) of the Act and we grant the application. The certificate may issue immediately.
