Decision No.227/2010
IN THE MATTER of the Sale of Liquor Act 1989
AND
IN THE MATTER of an application by PURE CATERING LIMITED pursuant to s.18 of the Act for renewal of an on-licence in respect of premises situated at 30 Te Mata Road, Havelock North, known as "Havelock North Community Centre"
BEFORE THE LIQUOR LICENSING AUTHORITY
Chairman: District Court Judge J D Hole
Member: Mr P M McHaffie
DECISION
This application by Pure Catering Limited, for renewal of an on-licence, is dated 14 September 2009. The licence fell due for renewal on 21 October 2009. The premises trades as a functions venue with hours authorised for the sale of liquor between 11.30 am and 12.30 am daily. No changes are sought to the conditions of the licence.
The Police, Medical Officer of Health and the Agency Inspector do not oppose renewal.
Advertising of the application attracted an objection from neighbouring residents contending that excessive noise emanating from the premises was causing unacceptable disturbance. The Agency referred the matter to the Authority for determination.
The applicant has addressed the objectors’ concerns and opposition to renewal is now withdrawn. Accordingly, we will deal with the matter on the papers.
We are satisfied as to the matters to which we must have regard as set out in s.22 of the Act. We renew the licence on the existing terms and conditions until 21 October 2012, that being three years from the first anniversary of the licence, and we authorise the issue of a notice of renewal.
DATED at WELLINGTON this 19th day of March 2010
