Decision No.317/2010
IN THE MATTER of the Sale of Liquor Act 1989
AND
IN THE MATTER of an application by DAVID
GRAEME MILLAR pursuant to
s.123 of the Act
for renewal of a
General Manager’s Certificate
BEFORE THE LIQUOR LICENSING AUTHORITY
Chairman: District Court Judge J D Hole
Member: Dr
J Horn
DECISION
We have before us an application by David Graeme Millar for renewal of his General Manager’s Certificate. The application was lodged with the New Plymouth District Licensing Agency in December 2009.
The Police and District Licensing Agency Inspector opposed the application as Mr Millar had been convicted with driving with excess breath alcohol. The offence took place in October 2009.
Because of the conviction, Mr Millar has agreed to a shortened renewal of his certificate. As a result, the opposition to the application has been withdrawn.
Accordingly, the certificate will be renewed, but for a lesser period of 12 months only. This means that it will next fall due for renewal on 18 December 2010. A notice of renewal is attached to this decision.
DATED at WELLINGTON this 6th day of April 2010
