DECISION
This is an application by Green Grass Limited for renewal of an on-licence in respect of premises situated at 8-18 Darby Street, Auckland, known as "Margarita’s". The business trades as a tavern with hours authorised for the sale of liquor at any time on any day. No changes are sought to the conditions of the licence.
Advertising did not attract any public objections but the Police and Agency Inspector opposed renewal on the basis of perceived poor management practices. The matter was referred to the Authority for determination at a public hearing.
In the interim ongoing discussions between the licensee and the reporting authorities have resulted in a significant improvement in how the business is being operated. As a consequence opposition to renewal has been withdrawn. Accordingly we deal with the matter on the papers.
We are satisfied as to the matters to which we must have regard as set out in s.22 of the Act. We renew the licence on the existing terms and conditions until 7 April 2012, that being the anniversary date of the licence and three years from the most recent date of expiry, and we authorise the issue of a notice of renewal.
