IN THE MATTER of the Sale of Liquor Act 1989
AND
IN THE MATTER of an application by PATRICIA MARIE GILBERT pursuant to s.118 of the Act for General Manager’s Certificate
BEFORE THE LIQUOR LICENSING AUTHORITY
Chairman: District Court Judge J D Hole
Member: Dr J Horn
FINAL DECISION
In decision NZLLA PH 686/2009, following a public hearing at Auckland on 25 June 2009, we adjourned an application by Patricia Marie Gilbert for a General Manager’s Certificate.
The Waitakere District Licensing Agency Inspector had opposed the application on the basis of Miss Gilbert’s failure to demonstrate a satisfactory standard of knowledge of the Act. She had no recent experience in the management of licensed premises and she did not have the committed support of an employer.
We adjourned the matter to give Miss Gilbert an opportunity to gain the necessary experience and knowledge at the end of which time we anticipated that she would undergo another interview with an Inspector.
The Agency Inspector has advised our Secretary that a further interview has now been conducted and Miss Gilbert has achieved a satisfactory standard. We also have a letter from Miss Gilbert’s employer confirming that she is to be promoted to act in a managerial capacity. The Inspector’s opposition is withdrawn
We are satisfied as to the matters to which we must have regard in s.121(1) of the Act and we grant the application. The certificate may issue immediately.
DATED at WELLINGTON this 26th day of July 2010
