Bedford [2011] NZLLA 1126 (10 October 2011)

Last Updated: 17 October 2011

[2011] NZLLA 1126

IN THE MATTER of the Sale of Liquor Act 1989

AND

IN THE MATTER of an application by HANNAH MOANA BEDFORD pursuant to s.118 of the Act for a General Manager’s Certificate

BEFORE THE LIQUOR LICENSING AUTHORITY

Chairman: District Court Judge J D Hole

Members: Dr J Horn

Mr P M McHaffie

FINAL DECISION

In decision [2010] NZLLA PH 1051, following a public hearing at Wellington on 31 August 2010, we adjourned an application by Hannah Moana Bedford for a General Manager’s Certificate for 12 months.

The Police had opposed the application on the basis of Ms Bedford’s declaration that she had incurred a conviction for a liquor related traffic offence committed in October 2009.

Ms Bedford presented well at the hearing and we were impressed by her knowledge and understanding of the responsibilities that go towards the efficient management of licensed premises. She also had the support of her employer.

Nevertheless, we adopted our commonly accepted approach of requiring a minimum ‘stand-down’ period to elapse following any conviction for an offence involving the consumption of liquor.

The Police have advised our Secretary that there have been no further matters of concern brought to their attention during the period of adjournment, and opposition to the application is now withdrawn.

We are satisfied as to the matters to which we must have regard in s.121(1) of the Act and we grant the application. The certificate may issue immediately.

DATED at WELLINGTON this 10th day of October 2011

B M Holmes
Secretary
