DECISION
We have before us an application by Jose Kleiman for renewal of a General Manager’s Certificate. The certificate fell due for renewal on 2 December 2009.
The Police opposed the application because although Ms Kleiman correctly declared in her applications that she had no convictions, she was facing active charges for assault following an incident on 22 November 2009. A conviction was subsequently entered in the Whangarei District Court on 18 January 2010.
The application was referred to the Authority in May 2010 for determination at a public hearing. Due to unforeseen circumstances an earlier fixture was required to be vacated and the matter was scheduled to be heard on 1 November 2011.
The Police have advised our Secretary that Ms Kleiman has continued to manage licensed premises without further incident and, given the passage of time since the offence they no longer wish to pursue opposition to renewal.
We are satisfied as to the matters to which we must have regard in s.126 of the Act and we grant the application. A notice of renewal is attached to this decision.
