Walker [2011] NZLLA 1191 (19 October 2011)

Last Updated: 30 November 2011

[2011] NZLLA 1191

IN THE MATTER of the Sale of Liquor Act 1989

AND

IN THE MATTER of an application by TANIA VERA WALKER pursuant to s.123 of the Act for renewal of a General Manager’s Certificate

BEFORE THE LIQUOR LICENSING AUTHORITY

Chairman: District Court Judge J D Hole
Member: Dr J Horn

DECISION

We have before us an application by Tania Vera Walker for renewal of a General Manager’s Certificate.

The Police opposed the application because Ms Walker had incurred a conviction for having driven with excess breath alcohol in March 2010. As a consequence she consented to suspension of her certificate by decision [2011] NZLLA 543, dated 17 June 2011.

Ms Walker further accepted a recommendation from the Police and District Licensing Agency Inspector that when next the certificate fell due for renewal the period of renewal would only be for 12 months.

We are satisfied as to the matters to which we must have regard in s.126 of the Act and we grant the application. The certificate is renewed for 12 months from 8 September 2011. A notice of renewal is attached to this decision.

DATED at WELLINGTON this 19th day of October 2011
